1. Acceptance of Terms

By accessing or using MilitaryNewsToday.com, associated domains, or any related services, applications, or content (collectively, the “Platform”), you agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree, you must discontinue use immediately. These Terms include our Privacy Policy and any additional policies referenced herein.

Offerings may include, without limitation: (a) defense news and intelligence updates (including AI-generated or AI-assisted articles and summaries); (b) company directory listings and profiles; (c) armored vehicle information, historical context, and technical overviews; (d) strategic reports and downloadable resources; (e) sponsored content, premium listings, and advertising services; and (f) B2B lead-generation tools and outreach solutions. We may modify, suspend, or discontinue any service at any time without notice.

4. User Accounts & Responsibilities

Users agree to: (a) provide accurate and current information; (b) keep credentials secure; (c) use the Platform only for lawful purposes; (d) not disrupt, interfere with, or damage the Platform; and (e) respect the intellectual property and other rights of the Company and third parties.

5. AI-Generated & Third‑Party Content; Platform Immunities

5.1 AI Notice. Portions of the Platform may be created, summarized, or rewritten using automated systems or AI tools. Such content may contain inaccuracies, omissions, or outdated information and is provided “AS IS” for general informational purposes only. No content is guaranteed to be original or free from third‑party claims.

5.2 No Professional Advice. Content on the Platform is not professional advice (e.g., legal, compliance, export control, procurement, engineering, or operational advice). Users must independently verify information before relying on it for any business, technical, safety, or procurement decision.

5.3 Third‑Party Content. The Platform may host, index, or link to User Content or third‑party materials. To the fullest extent permitted by law, we are not liable for statements or content provided by third parties. Without limiting the foregoing, the Company asserts protections available under 47 U.S.C. § 230 (Communications Decency Act) for third‑party content.

6. Technical Defense Data & Export Control

6.1 Informational Use Only. Any military or technical data, including armored vehicle specifications, is provided for general media and informational purposes. It is not an authoritative source of specifications or performance, and is not intended or suitable for operational, deployment, readiness, safety‑critical, engineering, or procurement decisions.

6.2 Export Control. The Platform does not intend to publish ITAR/EAR‑controlled technical data or other export‑restricted information. Users are responsible for their own compliance with ITAR, EAR, sanctions, and other export‑control laws.

6.3 Wrong/Outdated Data. Technical information may be incomplete, incorrect, or outdated. Users must independently verify any data and assume all risk for reliance on such information.

7. Intellectual Property; Limited License; No Scraping/No AI Training

7.1 Ownership. Unless otherwise indicated, all Content is owned by NX DEFENSE CORP or its licensors and is protected by U.S. and international laws.

7.2 Limited License. Subject to these Terms, we grant Users a limited, revocable, non‑exclusive, non‑transferable license to access and view the Platform for personal, non‑commercial use. Any other use (including copying, modifying, distributing, or creating derivative works) requires our prior written permission.

7.3 No Scraping / No Automated Access. Users may not scrape, crawl, spider, harvest, or use automated means to access, index, or download the Platform or its Content, including for database compilation, competitive analysis, or resale, without prior written authorization.

7.4 No Model Training / Text‑and‑Data Mining. Users may not use Platform Content (including metadata, tags, or databases) to train, fine‑tune, or evaluate AI/ML models or conduct text‑and‑data mining, except with our express written permission.

7.5 Trademarks. Company names, logos, and marks are the property of their respective owners. Use does not imply endorsement.

8. Company Profiles, Directories & Data Accuracy

8.1 Sources. Company listings and profiles may be created by our editorial team, by automated ingestion, and/or submitted by organizations. We may edit, verify, or remove any profile at our discretion.

8.2 Accuracy. We are not responsible for errors, omissions, or outdated information, including third‑party submissions or automated content. Users assume all risk from business or procurement decisions based on Platform Content.

8.3 Premium Profiles. Premium or sponsored profiles are paid promotional placements and may receive enhanced visibility or features.

9. Advertising, Sponsored & Native Content (FTC Compliance)

9.1 Disclosure. Sponsored, advertorial, or paid content will be clearly and conspicuously labeled as “Sponsored,” “Advertisement,” or similar.

9.2 Advertiser Responsibility. Advertisers are solely responsible for the accuracy and legality of their claims, disclosures, and offers.

9.3 Editorial Independence. Our editorial content is produced independently of advertising/sponsored arrangements unless expressly stated.

10. Paid Services, Reports & Subscriptions (Auto‑Renewal Compliance)

10.1 Fees. Certain services (e.g., premium listings, advertising, strategic reports) require payment through trusted third‑party processors.

10.2 Auto‑Renewal. Subscriptions automatically renew at the then‑current rate unless canceled before the renewal date. We will present renewal terms clearly and conspicuously at sign‑up and provide a simple online cancellation method via the user dashboard or by contacting info@militarynewstoday.com. These practices are intended to align with ROSCA and state auto‑renewal laws (e.g., California ARL).

10.3 Refunds. Except where required by applicable law, fees are non‑refundable for services already rendered or for elapsed subscription periods.

11. Privacy; Consumer Rights (CCPA/GDPR – Informational)

Your use of the Platform is subject to our Privacy Policy, which describes our data practices, including categories of data collected, purposes of use, and disclosures. Where applicable, the Privacy Policy will describe consumer rights (e.g., access, deletion, correction, and opt‑out of sale/share under CCPA/CPRA) and mechanisms to exercise those rights. International transfers may occur; when they do, we will describe the lawful bases or transfer safeguards in the Privacy Policy.

12. DMCA Notice & Takedown

We respect intellectual property rights. If you believe Content infringes your copyright, please submit a notice pursuant to the DMCA containing: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location; (c) your contact information; (d) a statement of good‑faith belief that use is not authorized; (e) a statement under penalty of perjury regarding the accuracy of the notice and your authority; and (f) your physical or electronic signature. The Platform may include links to third‑party websites, reports, or partners. We do not control or endorse third‑party sites and are not responsible for their content, policies, or practices.

14. Disclaimers of Warranties (AS IS / AS AVAILABLE)

To the maximum extent permitted by law, the Platform and all Content are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, non‑infringement, merchantability, or fitness for a particular purpose. Access may be interrupted, limited, or error‑prone. No content constitutes professional or compliance advice.

15. Limitation of Liability; Indemnification

15.1 Limitation. To the fullest extent permitted by law, the total aggregate liability of the Company and its affiliates, directors, officers, employees, and agents for any claim arising out of or relating to the Platform or these Terms is limited to the greater of (a) the amounts you paid to the Company for the service giving rise to the claim in the twelve (12) months preceding the event, or (b) one hundred U.S. dollars (US $100).

15.2 Exclusion of Damages. To the maximum extent permitted by law, no consequential, incidental, special, exemplary, punitive, or indirect damages shall apply, nor any lost profits, revenues, goodwill, or data, even if advised of the possibility of such damages.

15.3 Indemnification. You agree to indemnify and hold harmless the Company from and against claims arising from your use of the Platform, your User Content, or your violation of these Terms or applicable law.

16. Termination & Suspension

We may suspend or terminate access to the Platform (in whole or in part) at any time, with or without notice, including for violations of these Terms or misuse of the Platform. Upon termination, provisions that by their nature should survive (e.g., IP, disclaimers, limitations of liability, arbitration) will survive.

17. Governing Law; Dispute Resolution; Class Action Waiver

17.1 Governing Law. These Terms are governed by the laws of the State of Delaware, without regard to conflict‑of‑laws principles.

17.2 Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The seat of arbitration will be New York, New York, and the language will be English. Judgment on the award may be entered in any court of competent jurisdiction.

17.3 Class/Collective Action Waiver. Disputes must be brought in the parties’ individual capacities and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims.

17.4 Injunctive Relief. Notwithstanding the foregoing, either party may seek temporary or injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.

18. International Use; Sanctions

Users are responsible for compliance with local laws. Access to the Platform is not permitted where prohibited by applicable sanctions, embargoes, or other restrictions.

19. Electronic Communications; Notices

By using the Platform, you consent to receive notices and communications from us electronically. We may provide notices by email (including to the email associated with your account) or by posting to the Platform. You are responsible for keeping your contact information current.

20. Changes to the Terms

We may update these Terms from time to time. Material changes will be posted on the Platform with an updated effective date. Your continued use after changes are posted constitutes acceptance of the revised Terms.

21. Miscellaneous

  • Entire Agreement. These Terms (including incorporated policies) are the entire agreement between you and us with respect to the Platform.
  • Severability. If any provision is found unenforceable, the remaining provisions will remain in full force.
  • Assignment. You may not assign your rights or obligations without our prior written consent; we may assign ours in connection with a merger, acquisition, or sale of assets.
  • Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control (e.g., acts of God, war, terrorism, labor disputes, internet failures).
  • No Waiver. A failure to enforce any provision is not a waiver of future enforcement.
